TERMS AND CONDITIONS FOR THE PROVISION OF ONLINE CONSULTATIONS BY THE INTELLECTUAL PROPERTY PROTECTION OFFICE PATENT-SERVICE
§1. General Provisions
- These Terms and Conditions (hereinafter referred to as the “Terms”) define the rules for the provision of online consulting services by the Intellectual Property Protection Office PATENT-SERVICE Paweł Górnicki, hereinafter referred to as “PATENT-SERVICE”.
- The services are provided electronically, in accordance with the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2002 No. 144, item 1204) and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
- Acceptance of these Terms is a prerequisite for using the online consulting services.
§2. Scope and Nature of the Service
- PATENT-SERVICE provides consulting services in the field of industrial property protection, in particular: patents, trademarks, utility models and designs.
§3. Rules for Using Consultations
- The Client may use two types of consultations under the rules set forth in these Terms, always after prior appointment by completing and submitting the electronic form available on the website https://patent-service.pl/ (hereinafter the “Form”):
- a 15-minute free online consultation
- a 1-hourpaid online consultation
- Consultations are conducted via videoconference using Microsoft Teams.
- Consultations are scheduled for the date selected by the Client in the Form, from the available calendar slots.
- The appointment will be confirmed by an email sent to the Client’s email address provided in the Form.
- The meeting link will be sent to the Client in a subsequent email to the address provided in the Form.
- Each person may use the free 15-minute online consultation only once. If it is determined that the Client has already used the free consultation, PATENT-SERVICE reserves the right to cancel the appointment or charge a fee for the consultation in the amount specified in section 4.1.
- If, after the 15-minute free consultation, the Client wishes to extend the session, the conversation may continue as a paid 1-hour consultation, subject to the availability of both parties, or a new appointment may be scheduled.
- Lack of explicit consent from the Client to continue the consultation on a paid basis shall result in the termination of the service after 15 minutes.
- In the event of technical issues during the consultation on the part of PATENT-SERVICE, particularly disconnection, PATENT-SERVICE will make every effort to promptly restore the connection. In the event of technical issues on the Client’s side, PATENT-SERVICE will attempt to reconnect with the Client.
§4. Fees and Payments
- The first 15-minute consultation is free of charge.
- The cost of each commenced hour of a paid consultation is PLN 270 net and is communicated to the Client prior to its commencement.
- Payment may be made via bank transfer to the PATENT-SERVICE account or by another agreed method upon receipt of an invoice or bill by the Client.
- PATENT-SERVICE does not charge any fees without prior agreement and consent of the Client.
§5. Cancellation and Rescheduling of Consultations
- The Client may cancel or reschedule a paid consultation free of charge.
- In the event of the Client’s absence without prior cancellation, PATENT-SERVICE reserves the right to refuse further free consultations.
§6. Liability
- PATENT-SERVICE shall not be liable for decisions made by the Client based on information obtained during the consultation.
§7. Personal Data Protection
- Providing the personal data indicated in the form (First and Last Name, email address, phone number) is voluntary but necessary to conduct the online consultation.
- Clients’ personal data is processed in accordance with the Privacy Policy available on the PATENT-SERVICE website at: https://patent-service.pl/.
- Acceptance of these Terms signifies acknowledgment of the Privacy Policy and consent to the processing of personal data to the extent necessary for the provision of services.
§8. Final Provisions
- PATENT-SERVICE reserves the right to temporarily or permanently restrict access or permanently deny the possibility of using online consultations.
- PATENT-SERVICE reserves the right to amend these Terms. Any changes will be communicated by publishing a new version on the website.
- PATENT-SERVICE reserves the right to conduct a preliminary conflict of interest check. In the event of a conflict of interest, the consultation will not be provided.
- In matters not regulated by these Terms, the provisions of the Civil Code, the Act on the provision of electronic services, and other applicable Polish laws shall apply.
